It appears that the above plaintiffs are in talks with iContact to reach some sort of settlement. Letter from 1/6/2012 (pdf). The settlement would have to be with iContact because I can’t find any record of iContact turning over the names of the John Does who are the defendants

Notice how the letter does not state with whom the Plaintiffs are discussing settlement. iContact will reach a confidential settlement with the Plaintiffs, without ever having been named as a defendant in this lawsuit, to avoid bad PR. iContact’s entire business model relies on client confidence that the sort of activity alleged in this suit will not happen.
